Comedian Kunal Kamra faces FIR over ‘Traitor’ remark

Comedian Kunal Kamra faces an FIR for calling Deputy CM Eknath Shinde a “traitor,” while Shiv Sena workers are arrested for vandalizing his performance venue.

Stand-up comedian Kunal Kamra finds himself at the center of a political storm after making remarks about Maharashtra Deputy Chief Minister Eknath Shinde during a recent performance. The controversy has led to legal actions against Kamra and a violent backlash from Shiv Sena supporters, raising concerns about freedom of expression and political intolerance in the state.

The Controversial Performance

During a stand-up routine at “The Unicontinental Mumbai” in Khar, Mumbai, Kamra referred to Deputy Chief Minister Eknath Shinde as a “traitor” (Gaddar). He did so by modifying a popular Hindi song from the film “Dil To Pagal Hai,” singing, “Meri nazar se tum dekho to gaddar nazar wo aaye. Haaye.” This was an allusion to Shinde’s 2022 rebellion against then-Chief Minister Uddhav Thackeray, which led to a split in the Shiv Sena party.

Legal Actions Against Kamra

The performance did not sit well with members of the Shiv Sena. Shiv Sena MLA Murji Patel filed a First Information Report (FIR) against Kamra at the MIDC police station, accusing him of making derogatory and defamatory remarks about Eknath Shinde. The FIR was registered under sections of the Bharatiya Nyaya Sanhita (BNS), including Section 353(1), which pertains to publishing or circulating statements likely to incite any class or community to commit an offense.

In retaliation, Shiv Sena workers vandalized the venue where Kamra had performed. A group of approximately 40 individuals ransacked “The Unicontinental Mumbai,” causing significant property damage. The Mumbai police have arrested 13 Shiv Sena workers in connection with the incident.

The incident has elicited responses from various political figures. Maharashtra’s Deputy Chief Minister Ajit Pawar addressed the media, emphasizing the importance of responsible speech to prevent law enforcement intervention. He stated, “No one should go beyond the law and the Constitution. One should speak within limits. Differences of opinion may exist, but care must be taken to ensure that the police department does not have to intervene due to their statements.”

Shiv Sena (UBT) leader Aaditya Thackeray condemned the attack on the venue, questioning the state’s law and order situation. He remarked that only an “insecure coward” would react violently to a comedic performance.

Closure of the Venue

In response to the vandalism, the management of “The Unicontinental Mumbai” announced a temporary shutdown. They expressed concerns over providing a platform for free expression without jeopardizing their safety and property. The venue management invited artists and audiences to discuss and share their views, seeking guidance on respecting performers’ rights while ensuring safety.

Ongoing Investigations

Mumbai police have registered two separate offenses: one against Kunal Kamra for his remarks and another against the individuals who vandalized the hotel. Investigations are ongoing, and further actions will depend on the findings.

The incident involving Kunal Kamra’s performance and the subsequent reactions highlight the delicate balance between freedom of expression and political sensitivity in India. As the situation develops, it raises critical questions about the extent to which artistic expression can challenge political figures without provoking violent reprisals.
