Cruise Drugs Case: NCB opposes Aryan Khan’s bail plea

Aryan Khan’s bail petition was denied by Esplanade magistrate court on Friday in the Mumbai drug bust case.

Shah Rukh Khan’s son Aryan and other accused have sampled negative for Covid-19 and have been affirmed medically fit. Sameeer Wankhede, Zonal Director, NCB, had proposed the court to keep the impeached at the probe agency’s office in Mumbai as jail doesn’t admit prisoners without Covid test reports.

The bail plea of Aryan Khan and seven others imprisoned in the Mumbai drugs bust case coincidentally is on the birthday of mother Gauri Khan. A magistrate court heard the plea around 12:30 pm. Initially, the hearing was supposed to commence at 11 am. The hearing took place in front of Additional Metropolitan Magistrate RM Nilekar.

Meanwhile earlier today, all 8 accused comprising Aryan Khan who was kept at the NCB office last night was brought to Arthur road jail today. Three of the accused, Aryan Khan, Arbaz Merchant, Munmun were taken for the hearing; the other accused were directly sent to JC.

Aryan Khan’s lead counsel Satish Maneshinde spoke in favour of Aryan while ASG Anil Singh argued on behalf of the NCB and opposed the bail plea saying “My submission is to the first issue of maintainability. If the court decides then will argue on the bail plea.” Satish Maneshinde immediately opposed ASG saying he can’t dictate to the court what to do, post which Aryan was taken to Mumbai’s JJ Hospital for medical check-ups.

ASG defied the bail plea. He also put forward Section 37 of the NDPS Act. However, Satish Maneshinde referred to numerous judgements asserting that under Section 437 of the CrPC, there is an authority to consent remand or mandate bail. He also asserted that nothing solid was spotted in Aryan’s WhatsApp chats.

Maneshinde also argued that Aryan should be released on the basis of bail bond, says, “I thought that NCB and its law officers would know that no materials have been found with me nor in my bag and they let me go on the first day but they didn’t.” The court later rejected Aryan’s bail saying, ” No bail for Aryan Khan, plea not maintainable”

The court earlier gave 14-day judicial custody to SRK’s son, his friend Arbaaz A Merchant, model Munmun Dhamecha and five others. The Nationalist Congress Party, however, has been putting the gun on NCB official Sameer Wankhede over the raids. Nawab Malik is likely to hold a press conference around noon today after “collecting more data and information to expose the wrongdoings of the NCB”. He had previously released videos showing Kiran P Gosavi and Manish Bhanushali entering and fleeing the NCB office the same night the cruise ship was pillaged.
