Here’s why Congress leader Rahul Gandhi approached Gujarat High Court seeking stay on his conviction

In the defamation case “Modi Surname,” Congress leader Rahul Gandhi went to the Gujarat High Court on Tuesday, seeking a stay on his conviction. This came a day after the Surat Sessions Court denied his motion requesting a stay on his sentence.

Rahul Gandhi was also sentenced to an imprisonment period of two years in jail on March 23 under the Section 499 and 500 of the IPC in a case. His sentencing will, however, remain suspended until he exhausts all other legal challenges.

Following his conviction for his comments on the Modi family name, Rahul Gandhi lost his eligibility to serve as a member of the Lok Sabha. As required by the regulations of the procedural codes, he had to move out of the official bungalow allotted to him as Member of Parliament (MP) on 12 Tughlaq Lane. After he won the election for the Lok Sabha seat of Amethi in 2004, he was given the bungalow as his official residence while holding power in office.
