Hathras Gangrape Case: Supreme Court hears plea for transfer of probe to CBI or SIT with the transfer of the trial from UP to Delhi

The Supreme Court is currently hearing a PIL seeking the Hathras Gangrape Case to be investigated by Central Bureau of Investigation (CBI) or Special Investigation Team (SIT) and to transfer the case from Uttar Pradesh to Delhi.

The bench is headed by Chief Justice of India, S A Bobde and the plea has been filed by social activist, Satyama Dubey, advocates Vishal Thakre and Rudra Pratap Yadav.

The petitioners have stated that the UP government has failed to take appropriate action in the case. The victim was first gang-raped, then brutally assaulted. She died in a hospital in Safdarjung on 29th September. The police in a hurry cremated the body and said that the cremation was being carried out as per the wishes of the family, while the family said vice versa.

Today, the Uttar Pradesh government filed an affidavit to the Supreme Court. The affidavit stated, “the apex court should monitor the CBI investigation into the case by keeping the PIL pending before it.” The UP government has already requested the Centre to entrust the probe to the CBI as to bring an end to vicious, bogus and motivated propaganda by vested interests.

The affidavit validated the actions taken by UP Police, of cremating the victim’s body in the death if the night. The government said, “A vicious campaign has been unbridled to defame the state government.” The affidavit also explained in details the investigation that has been carried out so far into the matter. The UP government has alleged, the issue is being given caste and communal angle.
