The plea:
Vodafone Idea, burdened by heavy debt, has challenged the DoT’s additional AGR dues claim of Rs 9,450 crore, contending that it falls outside the purview of the Supreme Court’s earlier ruling on AGR liabilities. According to the company, the DoT’s computation includes elements already settled in prior orders and introduces new liabilities that amount to reassessment, which the court had previously barred.
The DoT, however, defended its position, stating that the additional demand stems from accounting adjustments and not a reassessment. Of the total, around Rs 2,774 crore pertains to FY18–19 dues of the merged Vodafone Idea entity, while Rs 5,675 crore relates to pre-merger Vodafone Group obligations.
Government’s stance:
Solicitor General Tushar Mehta noted that since the government now holds nearly 50% equity in Vodafone Idea, it remains a direct stakeholder in the company’s continuity. He suggested that a “mutually agreeable solution” could be worked out, subject to the court’s approval.
Background:
Earlier, the Supreme Court had dismissed similar pleas from telecom majors, including Bharti Airtel and Vodafone Idea, seeking correction of alleged errors in AGR calculations. The apex court reaffirmed that the DoT’s demands were final and disallowed any re-evaluation.
