28% GST on online gaming effective from Oct 1

28% tax on online gaming to become effective from October 1, says Finance Minister Nirmala Sitharaman after GST Council meeting on Wednesday.

The Finance minister, Nirmala Sitharaman announced at the briefing after the meeting, “…The council recommended that valuation of supply on online gaming & actionable claims in casinos may be done based on the amount paid or payable or payable to or deposited with the supplier by/or on behalf of the player, excluding the amount entered into the games, bets out of winnings of previous games & not on the total value of each bet placed…”,

 

The minister of finance for Delhi stated that Goa and Sikkim desired a tax based on gross gaming income (GGR) rather than face value. The minister of finance for Delhi was against the tax being imposed on internet gaming.

The panel resolved to impose a 28 percent GST on the full face value of bets placed during its most recent meeting, and the purpose of this Wednesday’s discussion was to discuss the necessary revisions to tax law to bring this idea into effect. Six months after the levy’s introduction, she said, there will be an evaluation of it.

 

The finance minister and representatives from each state make up the GST council, the highest decision-making body in the indirect tax regime, which deliberated on the wording of the necessary adjustments to allow taxing online gaming.
