It was during late evening on the 25th July, ’20 that Sushant Singh Rajputs father KK Singh has filed an FIR against actress Rhea Chakraborty and five others in which he made serious allegations against the actress.
The charges filed are under SEC 342 IPC [Wrongful confinement], SEC 380 IPC [Theft in the House], SEC 420 IPC [cheating and dishonesty], SEC 406 IPC [crinimal breach of trust], SEC 306 [IPC Abetment of suicide], SEC 341 IPC [wrongful restraint]
Now, if these charges are proved, Rhea Chakraborty’s career will surely be over and done with and she might also face imprisonment.
To know about the sections under which the charges have been filed in the First Information Report filed by Sushant’s father, we got in touch with Mumbai’s famous practising celebrity lawyer Advocate Devang Shah who gave us an insight of what these sections actually meant and what are their implications.
Shah elucidated, “Sec 341. Punishment for wrongful restraint —Whoever wrongfully restrains any person shall be punished with simple imprisonment for a term which may extend to one month, or with fine which may extend to five hundred rupees, or with both.
“Sec 342. Punishment for wrongful confinement—Whoever wrongfully confines any person shall be punished with imprisonment of either description for a term which may extend to one year, or with fine which may extend to one thousand rupees, or with both.
“Sec 380. Theft in dwelling house, etc—Whoever commits theft in any building, tent or vessel, which building, tent or vessel is used as a human dwelling, or used for the custody of property, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.
“Sec 406. Punishment for criminal breach of trust—Whoever commits criminal breach of trust shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both.
“Sec 420. Cheating and dishonestly inducing delivery of property—Whoever cheats and thereby dishonestly induces the person deceived to deliver any property to any person, or to make, alter or destroy the whole or any part of a valuable security, or anything which is signed or sealed, and which is capable of being converted into a valuable security, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.
“Sec 306. Abetment of suicide—If any person commits suicide, whoever abets the commission of such suicide, shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.
“Sec 506. Punishment for criminal intimidation—Whoever commits, the offence of criminal intimidation shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both; If threat be to cause death or grievous hurt, etc.—And if the threat be to cause death or grievous hurt, or to cause the destruction of any property by fire, or to cause an offence punishable with death or 1[imprisonment for life], or with imprisonment for a term which may extend to seven years, or to impute, unchastity to a woman, shall be punished with imprisonment of either description for a term which may extend to seven years, or with fine, or with both.
“Sec 120B is divided in two sub sections Sec 120B(1) and Sec 120B(2) – Punishment of criminal conspiracy— (1) Whoever is a party to a criminal conspiracy to commit an offence punishable with death, 2[imprisonment for life] or rigorous imprisonment for a term of two years or upwards, shall, where no express provision is made in this Code for the punishment of such a conspiracy, be punished in the same manner as if he had abetted such offence.
(2) Whoever is a party to a criminal conspiracy other than a criminal conspiracy to commit an offence punishable as aforesaid shall be punished with imprisonment of either description for a term not exceeding six months, or with fine or with both.]”
Well all of the charges have their own implications and consequences if proven. Now, only time will tell what hapens next in the case. We’re sure that the involvement of the Patna Police will mak matters more complex and many other things will come to the fore. What remains for us to see whetherMumbai police was indeed diligent in its scrutiny that is being done since one month or is there a lot of muck that is brushed under the carpet.
