A case has been registered at Agripada Police Station in Mumbai against one Ashraf on charges of sending obscene messages to a woman co-worker employed as a third-party telecaller at a major corporate company, according to ANI. The accused is currently under arrest.

The case has been filed under Sections 75, 78(2) and 70 of the Bharatiya Nyaya Sanhita and the Information Technology Act, 2000.

What the Victim Alleged

According to the victim’s statement to police as reported by ANI, the accused messaged her multiple times soliciting sexual relations and also sent obscene images while using derogatory language regarding her female colleagues.

The victim further stated in her complaint that when she informed the accused that she was Hindu, he responded with an alleged communal remark. The statement has been recorded as part of the FIR filed at Agripada Police Station.

Legal Sections Invoked

BNS Section 75 covers sexual harassment. Section 78(2) addresses stalking. Section 70 pertains to assault or criminal force with intent to outrage modesty. The IT Act 2000 provisions cover transmission of obscene material in electronic form — a charge increasingly invoked in workplace digital harassment cases as communication through messaging apps and workplace platforms becomes the primary medium through which such offences are committed.

The accused remains in custody. Investigation is ongoing.
