In a major legal and branding development, Fortis Healthcare Limited has officially acquired complete ownership of the ‘Fortis’ trademark and associated marks. This follows the Delhi High Court’s judgment dated March 25, 2025, which confirmed the public auction of the trademark in favor of Fortis Healthcare for a bid of Rs 200 crore.
The trademark was previously held by entities controlled by former promoters Malvinder and Shivinder Singh. The assets were attached by the Delhi High Court for the enforcement of a decree awarded to Japanese pharma company Daiichi Sankyo, following a 2016 arbitral award.
As per the court’s earlier directive on October 29, 2024, a public auction was held on December 21, 2024. Fortis emerged as the highest bidder and deposited 25% of the bid amount. Despite objections raised by RHC Healthcare regarding the auction process and valuation, the Delhi High Court rejected those arguments and confirmed the transaction.
The judgment also empowers Fortis Healthcare to update the ownership of the trademark in official trademark registry records. The next hearing related to the sale certificate and execution deed is scheduled for April 16, 2025.
Importantly, Fortis Healthcare clarified that no compensation or penalty costs are associated with this transaction, and there will be no adverse financial impact.
