In a landmark judgment, the Supreme Court of India has reinforced the Motor Accident Claims Tribunal’s (MACT) discretion to release compensation amounts either in full or in part to claimants. This decision clarifies the legal latitude of MACTs in managing compensation disbursements in motor accident cases.
The apex court’s ruling came in response to a legal challenge concerning the Tribunal’s authority to decide on the manner of compensation distribution. The case centered on a dispute where the claimants sought the immediate release of the entire compensation amount awarded by the Tribunal, while the insurance company contended that such disbursement was at the Tribunal’s discretion.
In the judgment, the Supreme Court underscored that Section 140 of the Motor Vehicles Act, 1988, and Section 168 of the same Act, grant MACTs the discretion to release compensation either fully or partially based on the specific circumstances of each case. While the Supreme Court’s ruling is a positive step towards a more equitable compensation process, it also presents certain challenges. MACT judges will need to carefully balance the need for discretion with the principles of consistency and predictability. There may be an increase in the complexity and duration of compensation cases as each case is evaluated on its unique merits.
