The Supreme Court’s decision came in response to a plea challenging the “Institutional Preference” quota exceeding 50% for graduates of the All India Institute of Medical Sciences (AIIMS) in postgraduate medical admissions. The petitioners had requested that the results be withheld until the matter could be further examined, arguing that such a delay would prevent potential third-party rights from being affected.
Senior Advocate PB Suresh, representing the petitioners, argued that holding back the results for just two more days would not cause significant disruption. However, Advocate Dushyant Parashar, representing AIIMS, countered that delaying the results would have significant repercussions on future admissions and cause undue delay for doctors nationwide awaiting their results.
Chief Justice of India DY Chandrachud, alongside Justices JB Pardiwala and Manoj Misra, refused to stay the result declaration, emphasizing the serious implications of halting the process. The bench noted the critical need for students across the country to receive their admission results in a timely manner.
The Court has adjourned the matter until August 20, 2024, to further deliberate on the petition. The ongoing case involves Dr. Sukrit Nanda and others challenging the quota system’s adherence to previous Supreme Court rulings, which set a 50% limit on institutional preference in postgraduate admissions.
The petitioners argue that AIIMS and other institutes have exceeded this limit, violating previous court decisions and affecting fair seat allocation. They seek a writ of mandamus to enforce the 50% quota limit and ensure that institutional preference is applied fairly.
The INI CET 2024 seat allotment results are scheduled for announcement today, following the petition’s examination in the Supreme Court.
