A recent ruling by Judge Gary Klausner determined that the series\u2019 claim of being based on true events is inaccurate.<\/p>\n<p>Harvey alleges that British screenwriter Richard Gadd, who created the show, made false statements about her, accusing her of abusing him, attempting to choke him, and being imprisoned for stalking. The drama escalated in July when Netflix sought a court injunction to dismiss the lawsuit. However, the recent ruling favored Harvey\u2019s right to proceed with the case, particularly because Netflix labeled the show as a true story, despite its fictional nature. Reports from <em>The Sunday Times<\/em> suggest that this \u201ctrue story\u201d tag was added at Netflix\u2019s insistence, despite Gadd\u2019s reservations.<\/p>\n<p>The judge noted that the show significantly distorted Martha\u2019s character, stating, \u201cThere is a major difference between stalking and being convicted of stalking in a court of law.\u201d He highlighted that there are also important distinctions between minor inappropriate actions and severe allegations like sexual violence, as well as between physical altercations and more extreme forms of violence.<\/p>\n<p>While Harvey was never explicitly named in the show, viewers quickly recognized the similarities, prompting widespread speculation online. Judge Klausner commented on this, saying, \u201cThe Series states that Plaintiff is a convicted criminal who sexually and violently assaulted Gadd. These statements may rise to the level of extreme and outrageous conduct.\u201d He also pointed out that while Harvey\u2019s alleged actions were concerning, the statements made by the defendants could have a more damaging impact on viewers.<\/p>\n<p>Although the judge dismissed Harvey\u2019s claims related to negligence and violation of publicity rights, he did allow her to continue with her lawsuit focused on intentional infliction of emotional distress.<\/p>\n<p>Despite the ongoing controversy, <em>Baby Reindeer<\/em> has emerged as both a critical and commercial hit.
