In response to the sexual assault allegations made against Sean ‘Diddy’ Combs by Joi Dickerson-Neal, Diddy’s attorneys have filed a motion to dismiss certain claims in the case. According to People, the attorneys argue that some of the allegations were brought under statutes that did not exist at the time of the alleged misconduct in 1991.
Specifically, Diddy’s lawyers contend that accusations related to revenge porn and human trafficking should be dismissed because the laws pertaining to these offenses were not in place at the time of the alleged assault. The New York State Revenge Porn Law and the New York Services for Victims Of Human Trafficking Law, cited in the complaint, were codified in 2019 and 2007, respectively, after the alleged incident occurred.
The filing asserts that these claims “cannot survive” the motion to dismiss due to the timing of the alleged assault and the enactment of relevant laws afterward. Additionally, Diddy’s attorneys characterize Dickerson-Neal’s claims as “false, offensive, and salacious.”
Regarding the incident detailed in the lawsuit, Dickerson-Neal alleges that in January 1991, when she was 19 years old, Diddy took her to a restaurant in Harlem and then to his recording studio. She claims she was drugged by Diddy and rendered unable to stand or walk independently. Allegedly, Diddy then sexually assaulted her at a location where he was staying, filming the assault, which was later viewed by her male friend and others.
Diddy has denied these allegations, asserting that Dickerson-Neal fabricated the story. The legal proceedings continue as Diddy’s attorneys seek to dismiss certain claims based on the timing of relevant statutes.
