On March 19, 2026, the <a href=\"https:\/\/www.businessupturn.com\/trade-policy\/tag\/national-commission-for-women\/\">National Commission for Women<\/a> (<a href=\"https:\/\/www.businessupturn.com\/trade-policy\/tag\/ncw\/\">NCW<\/a>) issued summons to Bollywood actors <a href=\"https:\/\/www.businessupturn.com\/trade-policy\/tag\/nora-fatehi\/\">Nora Fatehi<\/a> and <a href=\"https:\/\/www.businessupturn.com\/trade-policy\/tag\/sanjay-dutt\/\">Sanjay Dutt<\/a>, alongside the producers of the Kannada pan-India film <i data-path-to-node=\"2\" data-index-in-node=\"303\">KD: <a href=\"https:\/\/www.businessupturn.com\/trade-policy\/tag\/the-devil\/\">The Devil<\/a><\/i>, over the song \u201c<a href=\"https:\/\/www.businessupturn.com\/trade-policy\/tag\/sarke-chunari\/\">Sarke Chunari<\/a>.\u201d<\/p>\n<p data-path-to-node=\"3\">The controversy, which centers on allegations of \u201cobscenity and vulgarity,\u201d has reignited a perennial legal and ethical debate: Where does a woman\u2019s right to professional expression end, and where does the state\u2019s duty to protect \u201cpublic morality\u201d and \u201cwomen\u2019s dignity\u201d begin?<\/p>\n<p data-path-to-node=\"5\">The song \u201cSarke Chunari\u201d features a lyrical structure built on double entendres. Initial verses seemingly describe female anatomy in graphic detail, only for the \u201creveal\u201d to shift the context to an alcohol bottle. The NCW, taking <i data-path-to-node=\"5\" data-index-in-node=\"230\">suo motu<\/i> cognizance, termed the content \u201cprima facie sexually suggestive\u201d and potentially violative of the <a href=\"https:\/\/www.businessupturn.com\/trade-policy\/tag\/bharatiya-nyaya-sanhita\/\">Bharatiya Nyaya Sanhita<\/a> (BNS) and the <a href=\"https:\/\/www.businessupturn.com\/trade-policy\/tag\/it-act\/\">IT Act<\/a>.<\/p>\n<p data-path-to-node=\"6\">While the film\u2019s creators argue that the song is a stylistic choice within the \u201citem number\u201d genre, critics and the NCW argue that such content objectifies women, reducing their persona to a tool for titillation under the guise of entertainment.<\/p>\n<p data-path-to-node=\"8\">At the heart of this row is a clash between two fundamental pillars of the Indian Constitution, one the Freedom of Expression (Article 19(1)(a)) which the Filmmakers and artists argue that the Constitution protects their right to create content that may be provocative or unconventional. They contend that \u201cobscenity\u201d is subjective and that adults should have the agency to choose what they consume. On the other hand, we have Right to Dignity (Article 21) which, the NCW and proponents of the ban argue that freedom of speech is not absolute. Under Article 19(2), the state can impose \u201creasonable restrictions\u201d in the interest of \u201cdecency or morality.\u201d Furthermore, they posit that the systemic objectification of women in media contributes to a culture that undermines the fundamental right to live with dignity.<\/p>\n<p data-path-to-node=\"10\"><em>Historical Precedents: From \u2018Choli Ke Peeche\u2019 to \u2018Sheila Ki Jawani\u2019<\/em><\/p>\n<p data-path-to-node=\"11\">This is far from the first time Indian cinema has faced the NCW\u2019s gaze. The \u201cSarke Chunari\u201d row echoes several landmark cases such as the The <i data-path-to-node=\"12,0,0\" data-index-in-node=\"4\">Khalnayak<\/i> Controversy (1993); decades ago, the song \u201cCholi Ke Peeche Kya Hai\u201d faced similar heat for its suggestive lyrics. While it survived the censors, it set the template for the \u201citem song\u201d debate. We have the <i data-path-to-node=\"12,1,0\" data-index-in-node=\"4\">Honey Singh<\/i> Case (2013) from this decade, where the Punjab and Haryana High Court previously observed that lyrics depicting women in a \u201clewd manner\u201d cannot be protected under freedom of speech if they offend public order and decency. Currently,\u00a0<i data-path-to-node=\"12,2,0\" data-index-in-node=\"4\">Bobby Art International v. Om Tyagi<\/i> (Bandit Queen Case) forms the precedence \u00a0where the Supreme Court ruled that nudity or \u201cvulgarity\u201d is not obscene if it serves a specific cinematic purpose and is not intended to provide \u201cprurient interest.\u201d The \u201cSarke Chunari\u201d creators may struggle here, as \u201citem numbers\u201d are often viewed as commercial additives rather than narrative necessities.<\/p>\n<p data-path-to-node=\"14\">Interestingly, Nora Fatehi has distanced herself from the controversy, stating on Instagram, \u201cI would hate for anyone to think I endorse this.\u201d Her statement highlights a growing tension: the professional obligation of an actor to perform a scripted role versus their personal brand and social responsibility. It raises the question of whether the \u201csummons\u201d should target the performers at all, or focus solely on the writers and producers who hold the \u201ccreative\u201d reins.<\/p>\n<p data-path-to-node=\"16\">The summons issued for March 24 will likely serve as a litmus test for how modern India defines \u201cdecency\u201d in the digital age.
