Moving beyond the traditional \u201cblock and redirect\u201d model, this marks the first time the tech giant will actively disclose specific search behaviors to guardians. While the rollout begins next week in the UK, US, Australia, and Canada, the move has already drawn sharp criticism from the Molly Rose Foundation, which warns that such surveillance measures could inadvertently jeopardize teen safety by eroding trust.<\/p>\n<p>In the Indian context, this feature would stand in direct conflict with Section 9(3) of the\u00a0<span data-wiz-uids=\"bPaS1c_c\">Digital Personal Data Protection (DPDP) Act, 2023<\/span>, which strictly prohibits \u201cData Fiduciaries\u201d, in this context, the Meta, from \u00a0undertaking any <b data-path-to-node=\"5,0,0\" data-index-in-node=\"107\">\u201c<\/b><em>tracking or behavioral monitoring\u201d<\/em> of children. To send a parent an alert about \u201crepeated searches,\u201d Meta must, by definition, track and monitor a child\u2019s search behavior over time.<\/p>\n<p>But the crucial question is, would there be any flexibility with judicial interpretation of \u201ctracking for safety\u201d? In many Western jurisdictions, \u201csafety\u201d is a valid exception. In the current text of the <a href=\"https:\/\/www.businessupturn.com\/trade-policy\/tag\/dpdp-act\/\">DPDP Act<\/a>, the ban on tracking is near-absolute. Meta may need a specific government exemption (under Section 9(4)) to legally operate this feature in India without risking the \u20b9200 crore penalty for child-data violations.
