Bajaj Electricals faces Rs 1.16 crore demand as appeal is rejected

Bajaj Electricals Limited has received an adverse appeal order from the Appellate Authority, which has upheld a previous assessment order demanding ₹1.16 crore. The demand, issued by the Assistant Commissioner of Sales Tax in Bihar, includes a general penalty of ₹39.68 lakh.

The appeal order, dated 30 March 2026, was received by the company on 16 April 2026. This development follows the company’s earlier appeal against the assessment order, which was originally issued on 25 May 2023. The order was based on an alleged disallowance of transitional credit availed in ‘Form Tran 1’.

In response to the latest ruling, Bajaj Electricals‘ management is considering various legal options. These include filing an appeal before an appropriate appellate tribunal or a writ petition before the Hon’ble High Court.

The company has clarified that the financial impact of the appeal order, should it materialise, will be limited to the demand and penalty specified. Bajaj Electricals stated that there is no impact on its operational, financial, or other activities due to this order.

Bajaj Electricals has received an adverse appeal order from the Office of the Commissioner (Appeals), Central Excise, Customs & CGST, Jaipur. The order, dated 27 March 2026 and received by the company on 6 April 2026, pertains to an alleged short payment of tax for the financial year 2018-19. The appeal order raises a gross demand of ₹3.45 crore, which includes a penalty amount of ₹31.53 lakh.

The issue stems from a discrepancy between the company’s GSTR 1 and GSTR 3B filings for the said financial year. The Appellate Authority did not consider the submissions made by Bajaj Electricals, resulting in the adverse order.

Bajaj Electricals is currently evaluating its legal options, which may include filing an appeal before the appropriate appellate tribunal or a writ petition before the High Court. Bajaj Electricals sees tax demand reduced to Rs 15.63 lakh by appellate authority

Bajaj Electricals Limited has announced a significant reduction in a tax demand following an appeal. The Appellate Authority, under Section 107 of the CGST Act 2017, has reduced the total demand to ₹15.63 lakh, including a general penalty of ₹0.72 lakh, from an initial demand of ₹1.04 crore.

The original assessment order was issued by the Deputy Commissioner of Sales Tax, Danapur 1, Bihar, under Section 73 of the GST Act, 2017. The demand was related to the alleged disallowance of Input Tax Credit due to mismatches with GSTR 2A for the financial year 2017-18. Bajaj Electricals had already filed an appeal against this order with the Office of the Additional Commissioner (Appeals), Danapur 1, Patna West, Bihar.

The company is currently evaluating further legal options, which may include filing an appeal before a higher appellate authority or a writ petition before the Hon’ble High Court against the Appeal Order.
