Delhi Chief Minister and Aam Aadmi Party (AAP) leader Arvind Kejriwal is facing potential arrest by the Enforcement Directorate (ED) in connection with the alleged irregularities in the city’s excise policy. According to the ED’s claims, a conspiracy was hatched by several political leaders, including Kejriwal, his deputy Manish Sisodia, and Bharat Rashtra Samithi’s K. Kavitha (who was arrested last week). The alleged conspiracy involved framing the new excise policy to unduly benefit a “South Group” comprising certain liquor businessmen like Sarath Reddy, Magunta Srinivasulu Reddy, and Kavitha herself.

The ED alleges that this “South Group” was granted an inordinate number of retail zones – 9 out of the total 32 zones in Delhi – under the new excise policy. Moreover, the policy itself was structured with exorbitantly high-profit margins of 12% for wholesalers and a staggering 185% for retailers, which the agency claims was done intentionally.

As per the ED’s allegations, the conspiracy entailed collecting 6% of the 12% profit margin from the wholesalers as kickbacks, which would eventually make its way to the top AAP leaders like Kejriwal and Sisodia as illegal gratification amounting to ₹100 crores.

While Kejriwal and AAP have vehemently denied any wrongdoing, the ED seems convinced of the Chief Minister’s complicity based on evidence like his name appearing in witness statements, the frequent visits of accused Vijay Nair to Kejriwal’s office, and other documented trails.

“Politically motivated”, says Kejriwal

Arvind Kejriwal and the Aam Aadmi Party (AAP) have vehemently criticized the ED’s investigation as being “illegal and politically motivated.” They allege that the probe is a vengeful tactic by the ruling Bharatiya Janata Party (BJP) at the centre to target their government in Delhi. Kejriwal has portrayed himself as a victim of the BJP’s political vendetta, aimed at maligning his image and that of his party through these corruption allegations. By branding the summons as illegal, Kejriwal seems to be questioning the legitimacy of the ED’s actions and dismissing the charges as baseless.

On Wednesday, two chief justices of high courts were raised to the position of judges of the Supreme Court, days after the Supreme Court Collegium proposed their names.
Justices Ujjal Bhuyan and S Venkatanarayana Bhatti were appointed, according to tweets from Law Minister Arjun Ram Meghwal.

The Supreme Court Collegium recommended Justice Bhuyan, the Telangana High Court’s chief justice, and Justice Bhatti, his equivalent in Kerala, for promotion to the highest court on July 5.

Although the Supreme Court is officially authorised to have 34 justices, including the Chief Justice of India, it now only has 30. The Supreme Court’s working strength would increase to 32 once the two justices take their oaths, leaving two vacancies available. Justice Bhuyan, who was born on August 2, 1964, is the senior-most judge of the Gauhati High Court, his parent high court, and was appointed as a judge on October 17, 2011. Since June 28, 2022, he has held the position of Chief Justice of the Telangana High Court.

Justice Bhuyan has accumulated extensive knowledge in a variety of legal areas throughout the course of his protracted service as a High Court judge. In the field of tax law, he has developed expertise and subject knowledge. Additionally, he has handled a variety of matters, including taxes, as a Bombay High Court judge. His rulings deal with a wide range of legal and judicial concerns. The collegium had cited Justice Ujjal Bhuyan as a judge having a solid reputation for competence and honesty.

The Indian cricketer Prithvi Shaw and the city police were both served with a notice by the Bombay High Court on Thursday. The appeal, which was submitted by the social media influencer Sapna Gill, requested the court to cancel a FIR that was filed against her for allegedly attacking the athlete and demanding money from her.

The court is requesting their answer to the plea, in February of this year, a first information report (FIR) was filed after Gill and her friends got into a fight with Shaw and some of Shaw’s friends outside of a hotel in the suburbs of Mumbai over snapping of pictures. On Thursday, a two-chaired bench consisting of Justices S B Shukre and M M Sathaye issued a notice to the police and Shaw on Gill’s appeal for quashing the FIR against her and set the case for hearing in June. The notice concerned Gill’s request to have the FIR against her quashed.

Ali Kashif Khan, a lawyer for Gill, said in court that the police were conspiring with the Mumbai cricketer to fabricate a case against the social media influencer. Khan claimed that the police had filed the complaint.

Khan asked the court to order the police to get and save CCTV video from the hotel in the Andheri area where the altercation took place. The purpose of the film was to demonstrate what took on immediately before the altercation.

Gill included a request in the plea for the authorities to order them not to submit a chargesheet against her in connection with the matter.

New Delhi, July 15: Delhi High Court after hearing a petition Friday did not permit an unmarried woman to undergo medical termination of pregnancy at 23 weeks by saying that it virtually amounts to killing the fetus.

Counsel for woman petitioner submitted before the court that. As the woman is unmarried and in a great mental agony so is not in a position to raise the child. He submitted that law on medical termination of pregnancy in relation to unmarried women is discriminatory.

Delhi High Court Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad. After hearing said ,“We will not permit you to kill that child. We are very sorry. This virtually amounts to killing (the fetus)”.

The court said. ” We will ensure that the girl is kept somewhere safe. And she can deliver and go. There is a big queue for adoption”.

The Court said that the petitioner be kept somewhere safe. Until she delivers, the child can subsequently be given up for adoption.

Patna HC issues warrant of arrest against Sahara Chief Subrata Roy

Islamabad, April 11: The Islamabad High Court (IHC) on Monday rejected the plea that sought to place the names of the former prime minister Imran Khan and his party’s ex-ministers on the Exit Control List (ECL) and had also sought an investigation into an alleged threat letter, Geo TV reported. Chief Justice of IHC Athar Minallah issued a five-page long reserved verdict against the plea. While also slapping a Rs100,000 fine on the petitioner Maulvi Iqbal Haider.

Suvendu Adhikari sought Calcutta HC for CBI, says has been subjected to political vendetta

Suvendu Adhikari, leader of opposition in West Bengal Assembly and BJP MLA, has alleged that he was subjected to political vendetta and filed a petition before the Calcutta High Court seeking for a transfer of all criminal cases registered against him by the state police to the CBI.

Suvendu Adhikari has also prayed for an order of quashing of FIR’s registered against him by the state police.

Mr. Adhikari has filed the writ petition on Thursday where he sought to transfer the criminal cases against him to the CBI for an impartial investigation.

Mr. Adhikari has reported that he was being subjected to political vendetta since he was an opposition party leader and the cases were registered against him with false claims and had sought an order of the high court directing quashing of the FIRs against him.

The state police and the CID have probed a number of cases in relation to Suvendu Adhikari.

On Tuesday, the police were prompted on filing suo motu cases against Mr. Adhikari, as the BJP leader stoked a controversy when he mentioned that he got access to the call details of Amarnath K, Purba Medinipur District SP, while the ongoing nationwide row over the alleged investigating activities with the Pegasus spyware.

On Monday, in a meeting in the district’s Tamluk area, Suvendu Adhikari publicly suggested the local police chief refrain from doing anything that would lead to his transfer to Kashmir.

Earlier this year, Chief Minister Mamata Banerjee was defeated by the Nandigram MLA in assembly elections.

The district police had also probed a case of alleged pilferage of the relief material in Purba Medinipur.

There has been an investigation going on by the state CID for the unnatural death of a police constable who was a part of Suvendu Adhikari’s security team three years ago when in the TMC government he was a minister.

On the basis of a complaint from the constable’s widow, the murder case was put in motion and the probe was handed by the state to the CID.

SC refuses stay Delhi HC order to allow Central Vista project

On Tuesday, the Supreme Court refused to stay the Delhi High Court decision of May 31 which allowed the Central Vista project to work in the national capital to go on. The HC had dismissed a Public Interest Litigation (PIL) that sought stoppage of the construction activity and terming it motivated.

The Delhi HC imposed Rs 1 lakh cost on the petitioners, Anya Malhotra and historian Sohail Hashmi. It had mentioned that the project was if a national importance.

The Supreme court mentioned that the HC was right in concluding that the petitioners were selective in choosing the Central Vista project alone and did not research about similar public projects where the construction was in process.

The three-judge bench of the Supreme Court led by Justice AM Khanwilkar further stated that the petitioner should not have pursued the PIL before the high court further.

The Supreme Court said that the genuine PIL’s had caused problems and that the PIL’s had their own sanctity.

The Delhi high court had been told by the Centre that the workers staying at the site of the construction had been given all the facilities and COVID-19 protocols were being followed. The Central Visa project plans on constructing a new triangular Parliament House, a new residential complex that would house the Prime Minister and the Vice President, along with several new office buildings and a central secretariat to accommodate ministry offices.

According to the architectural consultant for the project, it had been conceptualised, looking at the traffic increase in the area in the upcoming years, by putting in enough mitigation efforts to ensure there was no congestion or impact on traffic movement.

As a part of the Central Vista Project, the 3 km long Rajpath from Rashtrapati Bhavan to India Gate would also be revamped.

Congress leader Rajeev Shukla on Thursday demanded that Karnataka Chief Minister BS Yediyurappa resigned from the post or be sacked to ensure a fair investigation against him, reported news agency ANI.

The High Court on Wednesday raised a green flag for the investigation in FIR filed against Yediyurappa Karnataka Chief Minister BS Yediyurappa and his former media advisor MB Maramkal in connection with “Operation Kamala,” reported ANI.

Congress leader Rajeev Shukla asserted that the BJP only talks of morality and cleanliness in politics but does not act against its people accused of corruption, reported NDTV.

He further contended that the BJP should solicit the resignation of Mr Yediyurappa and the governor should order an investigation against the Karnataka CM.

Mr. Shukla also emphasized that the issue was “very serious” and a serious investigation should be conducted.

The NDTV report also suggests that Mr. Yediyurappa allegedly offered money to the son of JD(S) MLA Naganagouda Kandkur, Sharanagouda to lure the latter to the BJP to topple the state government.

Mr. Shukla detailed the alleged involvement of Mr. Yediyurappa’s scams and mentioned that no probe has been ordered despite the high court giving directions in this regard. “The government should immediately probe the matter. The chief minister should resign and a quick decision should be taken on this,” Congress’ Rajeev Shukla said on Thursday.

HC grants bail to Kangana Ranaut in Javed Akthar defamation case

Javed Akthar had filed a defamation case against actor Kangana Ranaut a few months back. But Kangana failed to appear or respond to the summons by the magistrate court. This led to the court issuing a bailable warrant on the actress.

“For willful absence of accused (Ranaut) without any justified reasons, despite service of summons, issue a bailable warrant of ₹1,000 against accused Kangana Ranaut,” the Andhra metropolitan court stated.

In good news for the actor, the High Court of Karnataka has quashed the FIR against her. On Thursday, the actress appeared before the court and therefore, bail was granted to her. The HC also set aside FIR on another set of tweets made by the actor.

The tweets were against people who were opposing the new farm laws. During the hearing, Justice Sandesh asked Kangana’s advocate, “Who gave you the power to make such allegations? What would you have done if someone uttered the same words against you?”

Punjab & Haryana HC granted bail to dalit labour activist, Nodeep Kaur

The Punjab and Haryana High Court on Thursday (26th February) granted Bail To Dalit Labour Activist Nodeep Kaur in the third FIR Registered against her in relation to her arrest on January 12, amid the farmers’ protests.

The 24-year-old Dalit labour rights activist was arrested from the Singhu border on 12 January, where she was part of the ongoing farmers’ protest against the Centre’s contentious farm laws.

Earlier, Kaur was reportedly granted bail in two cases lodged against her alleging extortion. However, she continued to remain in jail in view of her arrest in a third case alleging offences under Section 307 (attempt to murder), Section 146 (rioting), and Section 353 (assault to deter a public servant from discharge of his duty) of the Indian Penal Code.

With the High Court granting bail in this third case today, Kaur can now be released from jail. The order was pronounced this morning by Justice Avneesh Jinghan who had called for all of Kaur’s medical reports earlier this week. In today’s hearing, he sought to examine whether the allegations of Kaur being tortured in custody were true. Bail was granted upon a prima facie observation that there was nothing to substantiate the allegations of an attempt to murder levelled against Kaur, among other reasons.

On January 12, she was protesting in the Kundli industrial area with twenty others, demanding wages. Clashes with the police ensued thereafter. The High Court had also registered a suo motu case following complaints about her “illegal confinement.”

The Court is also hearing a petition moved by the father of Shiv Kumar, who was arrested days after Kaur was arrested. Kumar’s father has alleged that Kumar has been tortured while in custody. On Wednesday, Justice Jhingan called for all of Kumar’s medical reports to assess these allegations of torture. Kumar’s case will be heard next on March 16.

Banks mark RComm account as fraud, ‘unjustified and unwarranted’, says Reliance Group

On 29 December, three state-run lenders, State Bank of India (SBI), Union Bank of India (UBI) and Indian Overseas Bank (IOB) classified accounts of the Anil Ambani owned Reliance Communication Ltd (RCom) and its two units Reliance Telecom Ltd (RTel) and Reliance Infratel Ltd (RInfra) as fraudulent.

Additionally, the SBI and the UBI have also marked Reliance Telecom Ltd account as fraud.

The Delhi High Court has also suggested that the union government is free to investigate or file any complaint proceedings against RCom and RTel. The resolution professional for RCom has accepted claims worth Rs 49,224 crore from 53 creditors, including banks, non-banking finance companies (NBFCs) and mutual funds (MFs), the Economic Times reported.

Today, Reliance Group in a statement has said that certain banks labelling accounts of the now defunct telecom firm – Reliance Communications (Rcom) – and its units as fraud was “unjustified” and “unwarranted”.

It also denied the reports on social media that RCom and its units owe lenders Rs 86,188 crore, saying they owe around Rs 26,000 crore to Indian banks and financial institutions as on the date of filing before the dedicated bankruptcy court.

On Wednesday, Reliance Group in a statement said, “The alleged ‘fraud’ classification by certain banks is entirely unjustified and unwarranted, and the Delhi High Court by an interim order has directed the same to be kept in abeyance for the time being, and the matter is now sub judice.”

Delhi lawyer fined Rs 500 for not wearing a mask inside his car now demands Rs 10 lakh compensation for public harassment

A lawyer in New Delhi who was imposed a fine of Rs 500 for not wearing a mask while driving a car alone approached the High Court asking for a compensation of Rs 10 lakh from the government officials for public mental harassment. According to a report from ‘Amar Ujala’, in his petition, he stated, “On 09.09.2020, at around 11 am, while going to his office, the petitioner’s car was stopped near the Geeta Colony by Delhi Police officials. A police constable Arora took his photo, while the petitioner was still sitting in his car and directed him to get out of the car.

“The lawyer has demanded a refund of the Rs 500 fine imposed on him as well as Rs 10 lakh as compensation. He says that the he wasn’t not wearing a mask in public space but was inside his car which is a private property. Hence the fine is not acceptable. The petition also demanded to see the executive order for wearing masks while traveling alone in a private vehicle.

Sushant Singh Rajput case: Rhea Chakraborty is in no hurry to apply for bail, reveals her lawyer

Advocate Satish Maneshinde statement read, “Even if we get a copy of the order today, we are not in a hurry and moving immediately… we will study the order, its implications and developments in the case at the NCB level and then decide. There’s no room for speculations… once it is filed we will share a copy of the bail application”.

In the meantime, Rhea Chakraborty and her brother Showik Chakraborty are currently being investigated by NCB after the WhatsApp chats regarding drugs. And the ED is looking after the money laundering part. Initially, it was KK Singh who filed a case against the actress probing to his son’s suicide. Bombay High Court passes ‘stay order’ on demolition of Kangana Ranaut’s office by BMC

The Bombay High Court has passed the stay order for further demolition of Kangana Ranaut’s Bandra office by BMC officials after the former appealed to the court. BMC officials were seen barging in Kangana’s private property with bulldozer and destroying her space about which the actress shared on her Twitter handle. Kangana filed her plea through her lawyer in Mumbai, on the basis of which the HC has passed a stay order on BMC. Now the HC has also asked BMC to submit the response to Kangana’s plea by tomorrow.
