
Actress Rhea Chakraborty,the prime accused in Sushant’s death case has suffered a double whammy on Wednesday. The Supreme Court dismissed her plea on transferring case from Patna to Mumbai. The court has maintained that the FIR registered in Patna was correct and Bihar was competent to demand for CBI investigation into the case.
The order also empowers the CBI to take over investigation into a new case without requiring any approval from the Maharashtra government.
Alarmed by the registration of FIR in Patna , Rhea had moved SC and pressed 406 of the CrPc which empowers the SC to effect inter-state transfer of cases in the interest of justice — for its transfer to Mumbai Police, pleading that only the Mumbai Police had jurisdiction over the incident that happened in Mumbai.
Justice Roy maintained that “The contour of the power under section 406 CrPC, it must be concluded that only cases and appeals (not investigation) can be transferred”. He also cited SC’s 1978 judgement in Ram Chander Singh Sagar case.
