Singapore’s real estate sector saw two significant fines related to a property transaction handled by an unregistered agent. Spencer Ng Boxiong, a 32-year-old team leader at ERA Realty Network, was fined S$8,000 by the court on August 19, 2023, for his role in facilitating a S$900,000 condominium purchase through his mentee, who was not registered with the Council for Estate Agencies (CEA).
Ng’s mentee, 33-year-old Benjamin Chang Yongxie, also faced consequences. Chang was fined S$21,600 on August 20, 2023, for his involvement in the transaction. Despite Chang not holding a valid real estate registration, Ng provided extensive guidance and encouragement, including advising Chang on how to handle the deal and secure a five-figure commission.
The case began when Irene, an agent from PropNex Realty who represented the sellers of the Symphony Suites condo, lodged a complaint with the CEA. Irene discovered that Chang was not registered when she noticed discrepancies in the transaction documents and Chang’s representation.
Court documents revealed that Ng was aware of Chang’s unregistered status but chose to support him in facilitating the condo purchase. Ng had coached Chang on how to conduct property viewings and encouraged him to finalize the transaction quickly. Despite knowing Chang was not officially registered, Ng signed off as the “purchaser’s salesperson” in the co-broke agreement to ensure Chang could complete the deal.
The CEA’s investigation, initiated by Irene’s complaint, led to significant fines for both Ng and Chang. Ng’s legal team argued that Ng’s actions stemmed from a desire to support his mentee rather than self-interest. However, the court emphasized the importance of adhering to registration requirements to maintain industry integrity.
Both Ng and Chang have paid their fines in full. The penalties for such breaches include potential jail terms or higher fines, underscoring the seriousness of ensuring all property transactions comply with legal standards.
